Administrative law deals with government regulation – a crucial aspect of every type of law practice.  The practical focus of the administrative law course is how to work with government agencies and the regulatory law these agencies generate and enforce.  The first part of the course looks at the processes government agencies use to literally create law through rulemaking and adjudication and also engage in investigations and law enforcement.  They operate in areas as diverse as environmental law, national security, communications, foreign affairs, taxation, labor-management relations, and much more.  The second part of the course considers judicial review and how courts impose constraints on government regulation based on constitutional concepts of separation of powers and checks and balances, as well as procedural due process and other constitutionally protected rights.  The course provides grounding in the basics of administrative law which any lawyer who practices law needs to understand.  This course is graded with a final examination.

Advanced Immigration Law: Immigration Law and Crimes

This course will address the various ways in which criminal conduct affects immigration status and benefits and the obligations of criminal defense lawyers, prosecutors, and immigration lawyers in regard to individuals with criminal histories. In particular, we will study:  lawyers’ obligations under Supreme Court jurisprudence (Padilla v. Kentucky), state law, and ethical requirements; how to analyze a criminal conviction to determine possible immigration consequences; ways in which a conviction may be ameliorated to reduce or eliminate immigration consequences, including under recent California legislation; immigration relief for persons with criminal histories; and immigration relief for victims of crime.  The course is designed for students who are interested in pursuing careers in immigration law or in criminal prosecution or defense.

Having taken or taking Immigration Law is strongly recommended.

In this course, you will learn the skills necessary to smoothly transition into Bar review and pass the Bar Exam.  In half of the class sessions,  you will review the substantive law of torts, contracts, and criminal law.  Using that knowledge, you will learn and practice strategies for the MBE.  In the other half of the class sessions, you will work in small sections with a Bar writing professor to learn how to excel on essays and the performance test.

To earn credit in the course, all students must complete all assignments and take a 6.5-hour mock bar exam on Saturday,  November 19.

This seminar will focus on contemporary issues in the conceptualization and regulation of misconduct in financial markets. We will explore wrongdoing in U.S. secondary markets for the trading of stocks, bonds, and other financial instruments, markets whose proper functioning facilitates the original offerings of such instruments by businesses seeking new financing. The seminar will begin with an exploration of the social and economic functions served by trading markets, including providing liquidity for investors and incorporating information into prices, which in turn serve as vital guides for the economy. We will also consider how rules and policy shape the ability of these markets to perform such functions. We will then explore issues that arise specifically in the regulation of wrongdoing in these markets, including manipulation, spoofing, high frequency trading, and broker execution quality. We will also consider the impact of technological innovation on the prevalence of and regulation around such activities.   

 

This seminar will be divided into two parts.  The first will consist of assigned readings, occasional short response papers, and in-class discussion.  The second part will entail student-led presentations and discussions, based on topics collectively identified and assigned earlier in the course.

For decades energy has been one of the most critical state, national, and global issues. This class is an overview of the legal and policy issues associated with the development and use of energy resources. This course intersects the disciplines of environmental law, natural resources law, administrative law, and publicly regulated industries. The class will study the environmental and resource management issues relating to solar, wind, hydroelectric, coal, oil, natural gas, and nuclear power. It will also cover the causes and regulations of global climate change and its impact on the energy sector. The class will study the regulation of the electricity industry, including the causes of the 2001 California energy crisis and electricity-ignited wildfires. The course will examine international energy issues including international climate change agreements, tariffs, and sanctions. This class will be of value to students interested in environmental law, natural resources law, water law, administrative law, and international law.  Students will write a research paper for the final. 

This class begins Monday, August 15, and ends Wednesday, November 2.

The course analyzes a hypothetical patent litigation using a US Patent and file history along with other documents. Grades are based on a variety of exercises related to claim construction charts, infringement and invalidity analysis, serving and responding to discovery, expert reports, depositions, and motions as well as class participation. After registering students will be asked to sign up for interview slots that will earn them the 25 hours required. As a practical matter, students will need at least a 2.5-hour block of availability from 11:30-3 on Wednesdays to get to the courthouse and conduct interviews.

In addition to advising clients, students will also receive 15.5 hours of instruction in the Fundamentals of Employment Law class that covers mediating employment law disputes, wage and hour law, wrongful termination, harassment, discrimination,  domestic violence, labor trafficking, retaliation, leave acts, workers compensation, unemployment insurance, state disability insurance, ERISA, privacy, workplace immigration issues, and union labor law.  Students will conduct a mediation of a case filed at the Equal Employment Opportunity Commission.  Students will conduct or observe an EEOC mediation. Work toward social justice is part of the professional responsibility of all lawyers, and an aspiration for social justice animates many law students. This course provides an opportunity to consider the relationship between law and social justice in several different contexts, including the structure of the legal profession and the delivery of legal services; the efforts to achieve social justice and civil rights through litigation in work, subsistence, housing, and procedural due process; the problem of access to courts and the role of the judiciary; and the role of lawyers working with community movements.  
 
To ground these theoretical explorations in real-life practice, the course will feature presentations by practitioners and advocates who work to advance racial justice,  public interest and social justice.  Instead of a final exam or research paper, students will work in teams to produce written “case studies” of a Bay Area social justice lawyering topic of their choosing. At the end of the semester, we will hold a day-long mini-conference for students to present their work to faculty, students, and interested members of the Santa Clara local social justice community.

Introduces students to the federal regulatory law governing the ownership and operation of broadcast radio and television, cable television, satellite video technologies, and the Internet. The course will also examine state laws relevant to Internet regulation including broadband Internet buildout by municipalities and net neutrality. Emphasis is placed on students learning to engage in a comparative analysis of the regulatory schemes for various communications technologies. Students will examine regulations in light of constitutional issues and administrative law. This course will examine the Communications Act’s legislative goals including promoting competition, access, and protecting public safety. It will examine regulatory proceedings that seek to advance First Amendment values by promoting diversity of voices and viewpoints. This course hones timed analytical writing skills necessary to successfully draft a 90-minute performance test as a part of the Bar Exam. Through timed, in-class practice, students will develop a solid understanding of the organization, depth, and precision required on the performance test, including how to read, analyze, and synthesize legal and factual materials quickly and accurately. Students will write five (5) performance tests in-class, and will receive regular feedback from their instructor. Enrollment is limited to students in their final year of law school.

Class will only meet for the first five weeks of the semester.

  • Understand the components of a real estate sale including the role of an attorney and broker, purchase agreements, escrow, and title insurance
  • Understand concepts of transfer, recording, disclosure issues, defective title issues
  • Understand mortgages, deeds of trust, foreclosure, assignment, lien priority, and subordination
  • Be able to demonstrate legal analysis, reasoning, and problems solving skills to reply to hypothetical questions as given on the California Bar Exam and the Multistate Bar Exam.
  • Be able to analyze and write a concise and comprehensive answer to hypothetical essay questions as given on the California Bar Exam.

NOTE:  this class is subject to the grade curve.  An overview of the law and practice of real estate purchases and sales, covering bar-tested materials (MBE and essay), common law, and California statutory modifications.  This course has been reduced to two units.

This course will survey the law governing American elections as well as the social justice of voting rights. We will cover the factual and legal history of the electoral college, voting rights, representation and districting, partisan and racial gerrymandering, minority representation, election administration, and campaign finance laws. We will learn about the legal systems involved in the administration of our campaigns, elections, and voting rights. This seminar requires your participation in the legal analysis of current events and challenges to the Voting Rights Act. Together we will examine the principles that have shaped the legal framework for elections and apply social justice principles to modern-day outcomes. Attendance during the first class is mandatory. Students who do not attend will be dropped.
