Santa Clara University School of Law, through the support of the Heafey Center for Trial and Appellate Advocacy and the Judge William Ingram Inn of Court, announce the 2019 Judge William Ingram Symposium. The Symposium will be held on the campus of Santa Clara University on the evening of January 16, 2019.

The title of the 2019 Symposium is: What California Lawyers Need to Know About the New Amendments to the Rules of Professional Conduct of State Bar of California.

The 2019 Symposium will feature a discussion of the recent amendments to the California Rules of Professional Responsibility that were approved by the California Supreme Court, and became effective on November 1, 2018. The amendments have made substantial changes to several important rules concerning regulation of attorneys and the discipline of attorneys in California. Some of the topics of discussion include: the separation of disciplinary function of the State Bar from the attorney development and support function; the role of the disciplinary rules to support or advance broader social issues, and the movement of the California Rules to ABA standards for the regulation of attorneys.

Speaker bios:

Merri A. Baldwin

Ms. Baldwin is co-chair of the firm’s Attorney Liability and Conduct Practice Group, and a member of the Complex Commercial Litigation Practice Group. She focuses on litigating business disputes and attorney liability matters, including trials, arbitration and mediation, and appeals. She is a certified specialist in Legal Malpractice Law, California Board of Legal Specialization.

Ms. Baldwin represents both plaintiffs and defendants in complex litigation matters, including claims of breach of contract, fraud, and partnership disputes. A significant part of her practice involves handling attorney liability and conduct issues, particularly claims of legal malpractice, breach of fiduciary duty, attorney sanctions and motions to disqualify. She regularly counsels lawyers and law firms on legal ethics and law practice management issues, as well as partnership disputes. She represents attorneys in disciplinary and admission matters before the State Bar of California, and handles attorney-client fee disputes. Ms. Baldwin has handled both jury and court trials, and has significant arbitration experience. She has testified as an expert in the areas of legal ethics and attorney standard of care.

Ms. Baldwin was the President of the Bar Association of San Francisco in 2017, and is past chair and member of the State Bar of California Committee on Professional Responsibility and Conduct. She is a committee co-chair for the American Bar Association Litigation Section Committee on Professional Services Liability Litigation. Ms. Baldwin has served as the vice-chair of the Bar Association of San Francisco’s Attorney-Client Fee Dispute Program, and received an Award of Merit in 2008 from the Bar Association of San Francisco for her role on the marriage fairness task force. She has been named by Super Lawyers magazine as one of the top attorneys in Northern California every year since 2006. She is a fellow of the American Bar Association, and regularly represents pro bono clients through the Justice and Diversity Center. She provides ethics and related advice to a number of public interest and civil rights legal organizations.

Ms. Baldwin frequently lectures to attorneys and professional organizations and publishes articles on issues related to litigation, legal malpractice and ethics issues. She is a part-time lecturer at the University of California, Berkeley School of Law, where she teaches professional responsibility. She is co-editor of “The Law of Lawyers’ Liability,” published in 2012 by First Chair Press and the American Bar Association.

Alison Buchanan

Alison Buchanan is a Shareholder in Hoge Fenton’s Silicon Valley office, where she focuses her practice on business litigation, and represents clients in complex business disputes, including contract, fraud, misappropriation of trade secrets, and unfair competition claims. She has significant trial experience, which includes serving as lead trial counsel in several recent trials.

Alison is also a Certified Specialist in Legal Malpractice Law as certified by the State Bar of California Board of Legal Specialization. Her additional experience in employment and real estate litigation makes her a valued resource for her clients. Alison is a sought-after speaker on attorney ethics Alison was named a “Northern California Super Lawyer” for 2018, 2017, 2016, 2015, 2014 and 2013, as chosen by her peers and through the independent research of Law & Politics and San Francisco Magazine. She was named a Northern California “Rising Star” in 2012.

Stephen McG. Bundy

Mr. Bundy is Of Counsel to Taylor & Patchen. His areas of practice include civil procedure, complex litigation, and legal ethics. He serves as General Counsel to the firm.

Stephen was for many years Professor of Law at the School of Law, University of California, Berkeley retiring in 2013. At Berkeley, his scholarship and teaching centered on civil procedure, alternative dispute resolution, and legal ethics. He was awarded the School’s Rutter Award for Teaching Distinction in 2011. He is currently Professor of Law, Emeritus. In that capacity, he has continued to teach courses in complex litigation at both Stanford and Berkeley. Stephen is a member of the State Bar of California standing Committee on Professional Responsibility and Conduct (COPRAC). He has lectured widely on issues of professional ethics, served dozens of times as an expert witness in legal ethics and malpractice matters, and frequently counsels law firms, nonprofits, and clients on professional ethics issues.

Mr. Bundy graduated from Harvard University in 1973. He received his law degree in 1978 from the School of Law, University of California, Berkeley. After graduation from law school, Stephen clerked for Judge John J. Gibbons of the United States Court of Appeals for the Third Circuit and was associated with the New York law firm of Cravath Swaine & Moore, where he specialized in litigation.

Donald J. Polden (moderator)

Professor Polden was Dean of Santa Clara University School of Law from 2003 to 2013 and he currently teaches antitrust law, sports law and leadership for lawyers at the law school. He also serves as the Director of the Heafey Center for Trial and Appellate Advocacy at Santa Clara Law.
