Course Description:
This course simulates practice in administrative post grant proceedings before the U.S. Patent and Trademark Office, with special focus on petitions for inter partes review by the PTOs Patent Trial and Appeal Board. Students will receive skills
training in prior art searching, patent validity analysis, petition drafting, and oral advocacy. IP Litigation, which focuses on litigation in district court, and Post Grant Patent Proceedings are complimentary classes that focus on different aspects of patent practice. Students who have taken IP Litigation are encouraged to enroll, but IP Litigation is not a prerequisite for this course and students who have not taken (or do not plan to take) IP Litigation are welcome to enroll. In addition, students planning to take both courses may take them in either order. Prerequisite: IP Survey. Recommended, but not required: Patents.
