Administrative Law

Administrative law deals with government regulation – a crucial aspect of every type of law practice.  The practical focus of the administrative law course is how to work with government agencies and the regulatory law these agencies generate and enforce.  The first part of the course looks at the processes government agencies use to literally create law through rulemaking and adjudication and also engage in investigations and law enforcement.  They operate in areas as diverse as environmental law, national security, communications, foreign affairs, taxation, labor-management relations, and much more.  The second part of the course considers judicial review and how courts impose constraints on government regulation based on constitutional concepts of separation of powers and checks and balances, as well as procedural due process and other constitutionally protected rights.  The course provides grounding in the basics of administrative law which any lawyer who practices law needs to understand.  This course is graded with a final examination.

Advanced International Human Rights Clinic A

Enrollment in this course is limited to those students who successfully complete Course No. 727 (International Human Rights Clinic), and subject to the Clinic Director’s approval. Students enrolled in this advanced course will continue to work on previous human rights clinic projects and are expected to act as team leaders. Students must register for 2 units of academic credit, which will be graded. This is the “A” portion of the course. Additionally, students may register for up to 2 additional units that are not graded (credit/no credit). This is the “B” portion of the course. Students must submit the International Human Rights Clinic Application Form and obtain a permission number from the professor in order to register for this course (contact FJRivera@scu.edu).

Advanced Legal Writing: Bar Exam

Credit/No Credit.

In this course, you will learn the skills necessary to smoothly transition into Bar review and pass the Bar Exam.  In half of the class sessions,  you will review the substantive law of torts, contracts, and criminal law.  Using that knowledge, you will learn and practice strategies for the MBE.  In the other half of the class sessions, you will work in small sections with a Bar writing professor to learn how to excel on essays and the performance test.

To earn credit in the course, all students must complete all assignments and take a 6.5-hour mock bar exam on Saturday,  November 20.

Enrollment is limited to JD students in their final semester of law school only.

Advanced Trial Techniques (Trial Team)

Experiential Course.  Enrollment based on tryouts held in Spring 2021. One year, two semester course beginning in Fall 2021. Students should obtain permission number from instructors. Attendance is mandatory, as well as participation in regional/national competitions – online or in person, depending on restrictions.

Students may earn no more than 8 units of academic credit in all Honors Moot Court and Honors Trial Team activity (including Honors Moot Court Internal, Honors Moot Court External, Honors Trial Team External, and all Honors Moot Court Boards.)   All units are graded CR/NC.

Effective Fall 2021:  Students who complete Advanced Trial Techniques will have two of the five units apply towards this limitation, allowing for six more units in other moot court activities.  Advanced Trial Techniques is a graded course. All other moot court units are graded CR/NC.

Capital Markets and Financial Misconduct Seminar

This seminar will focus on contemporary issues in the conceptualization and regulation of misconduct in financial markets. We will explore wrongdoing in U.S. secondary markets for the trading of stocks, bonds, and other financial instruments, markets whose proper functioning facilitates the original offerings of such instruments by businesses seeking new financing. The seminar will begin with an exploration of the social and economic functions served by trading markets, including providing liquidity for investors and incorporating information into prices, which in turn serve as vital guides for the economy. We will also consider how rules and policy shape the ability of these markets to perform such functions. We will then explore issues that arise specifically in the regulation of wrongdoing in these markets, including manipulation, spoofing, high frequency trading, and broker execution quality. We will also consider the impact of technological innovation on the prevalence of and regulation around such activities.   

This seminar will be divided into two parts.  The first will consist of assigned readings, occasional short response papers, and in-class discussion.  The second part will entail student-led presentations and discussions, based on topics collectively identified and assigned earlier in the course.

Domestic Violence Minicourse

Class will meet on Saturday, September 25th and October 23 from 10:00 am – 12:00 pm and from 1:00 pm – 5:00 pm.  Attendance on both days is required. Students will learn client counseling techniques and other practical skills through in-class exercises that will be held on both days.  Final grades will be based on (1) completion of all in-class exercises; (2) handing in a 1 to 2 page reflection essay due the morning of the first class; and (3) completion of a short final paper (minimum 6 and no more than 10 pages) addressing a current topic in domestic violence law. Paper topics must be instructor-approved no later than March 21. The paper will be due during the final exam period.

The practice of domestic violence law requires an understanding of legal systems as well as complex social issues. This minicourse begins with an understanding of domestic violence; how it manifests in families; its negative impact on victims and children; and its potential for lethality. Ethical DV practice will be discussed within an interdisciplinary context, including law enforcement, mental health, community-based organizations, and court systems. Students will recognize that domestic violence has broad implications beyond criminal and family law, e.g. immigration, child welfare, elder abuse, employment, housing and federal law, especially concerning firearms.

The School of Law enters student teams in a number of interschool, or external, trial competitions. These are hosted by law schools and other organizations around the country. During the first year of competing, students enroll in Advanced Trial Techniques, learning advanced litigation and trial strategy, and competing in trial competitions. Successful students may apply to serve on trial team again in subsequent years. The purpose of this course is to blend substantive patent law knowledge with practical application in a litigation context. The course emphasizes litigation skills including client relations, developing the factual record, strategic counseling, and motion practice. It will be of particular interest to those who plan to practice in the areas of patent litigation, patent prosecution, or patent licensing. The course analyzes a hypothetical patent litigation using a US Patent and file history along with other documents. Grades are based on a variety of exercises related to claim construction charts, infringement and invalidity analysis, serving and responding to discovery, expert reports, depositions, and motions as well as class participation. Limited enrollment. Professor does not allow taping of this class; but is willing to have a student tape a class with the permission of the professor for personal use only.  Approved IP LLM course.

KGACLC Workers' Rights Interviewing, Advising and Mediation Clinic

Students must attend a mandatory training class on Saturday, August 21 from 8:30 a.m. to 5:00 p.m..  Thereafter, students must spend 27 hours advising at the Workers’ Rights Clinic. Clinic meets on the following Tuesdays from 6:00 pm – 9:00 pm: Aug. 24,31; Sept. 7,14,21,28; Oct. 5,19,26   Class meets on the following Thursdays from 6:00 pm – 8:00 pm: Aug. 26; Sept. 2,9,16,23,30; Oct. 7. Students may not take more than one interviewing and advising class without the prior approval of the instructors. Students will provide advice to low income clients regarding problems in the workplace such as wrongful termination, harassment, discrimination, unpaid wages, and failure to pay overtime. In addition to advising clients, students will also receive 15.5 hours of instruction in the Fundamentals of Employment Law class that covers mediating employment law disputes, wage and hour law, wrongful termination, harassment, discrimination,  domestic violence, labor trafficking, retaliation, leave acts, workers compensation, unemployment insurance, state disability insurance, ERISA, privacy, workplace immigration issues, and union labor law.  Students will conduct a mediation of a case filed at the Equal Employment Opportunity Commission.  Students will conduct or observe an EEOC mediation. This course is graded. Students may also enroll in independent study for additional units.

Online Dispute Resolution: The State of the Art

Class will meet in person on the following dates/times: September 17th: 4-7:00pm, September 18th: 9am-12pm, 1pm-5pm, September 19th: 9am-12pm. All students will be expected to watch and interact with 320 minutes of recorded materials.

Enrollment is limited to 30 students. There are no prerequisites but knowledge of mediation would be helpful but is not required. The grade in the course will be based on class participation and a short paper. Students will need to bring a laptop with internet access.

Performance Test Workshop

This course hones timed analytical writing skills necessary to successfully draft a 90-minute performance test as a part of the Bar Exam. Through timed, in-class practice, students will develop a solid understanding of the organization, depth, and precision required on the performance test, including how to read, analyze, and synthesize legal and factual materials quickly and accurately. Students will write five (5) performance tests in-class, and will receive regular feedback from their instructor. Enrollment is limited to students in their final year of law school.

Class will only meet for the first five weeks of the semester.
