The discussion highlights copyright case law during the first seven months of 2020. Cases to be discussed include Georgia v. Public.Resource.Org, Inc., a Supreme Court case on the copyrightability of statutes and statutory annotations commissioned by a legislature; Allen v. Cooper, a Supreme Court case upholding state sovereign immunity against claims of “piracy” of photos and videos of a real pirate ship; Skidmore v. Led Zeppelin, upholding a jury verdict that the rock classic “Stairway to Heaven” did not infringe the song “Taurus” by Spirit lead singer Randy California; Castillo v. G&M Realty, upholding an award of $6.75 million in statutory damages for the destruction of graffiti art installed at the 5Pointz building in New York; and Solid Oak Sketches, LLC v. 2K Games, Inc., holding that the use of NBA player tattoos in the NBA 2K videogame was impliedly licensed, was de minimis use, and was fair use.
