This groundbreaking Course for experienced mediators will assist participants in adapting to work online and equip them with skills and technology to launch an Online Mediation practice. This course is being offered in collaboration with Mediate.com.

Participants will:

• Understand the differences between ADR, ODR and hybrid mediation
• Explore ODR applications and case volumes—including e-commerce/consumer, courts, family, workplace
• Understand when to use ODR—and when to avoid using it
• Adapt mediation skills to online practice—as well as acquire new skills
• Become proficient at using Online Mediation tools and platforms through hands-on training
• Examine Online Mediation ethics and practitioner obligations
• Create a plan for growing their online mediation caseload

Faculty:

The Faculty are highly respected as leaders in their fields, teaching System Design and ODR throughout the U.S. and internationally. Their writings advance these disciplines in important ways: Janet, as co-author of the forthcoming System Design; and Colin is co-author of The New Handshake: Online Dispute Resolution and the Future of Consumer Protection (ABA Publishing 2016) and Online Dispute Resolution for Business (Jossey-Bass 2002).

Colin Rule is Vice President of Online Dispute Resolution for Tyler Technologies. As a pioneer in ODR he helped develop the ODR systems for several Silicon Valley internet technology companies including eBay and PayPal, where he served as Director of Online Dispute Resolution from 2003 to 2011. Prior to joining Tyler, he founded Modria, the leading provider of ODR technology. Colin is Lecturer in Law at Santa Clara Law and Stanford Law School.

Clare Fowler serves as Managing Editor and Director of Caseload Manager at Mediate.com. Previously, Clare worked as Career Advisor at Pepperdine Dispute Resolution Department and for the University of Oregon’s Conflict and Dispute Resolution Master’s Program. Her current book project is a guidebook for HR directors dealing with high conflict employees. Clare mediates and regularly conducts trainings in the area of workplace disputes.

Janet Martinez is Director of the Gould Negotiation and Mediation Program and Senior Lecturer in Law at Stanford Law School. Formerly Senior Counsel for McKesson Corp. and Senior Associate for the Consensus Building Institute, she teaches advanced negotiation, dispute system design, and ADR, and conducts research on online dispute resolution, sustainable groundwater management, and international dispute resolution.
