Requirements
A Privacy Law Certificate candidate must satisfy the following requirements:
1. Coursework. A candidate must complete, with a C – or better (or P, where permitted): (1) Privacy Law, (2) Comparative Privacy Law, and (3) at least 3 elective courses from the following list:
Advertising & Marketing Law |
How Engineers, Businesspeople and Lawyers Communicate With Each Other |
Not all of these courses are regularly offered. The Certificate Supervisor may designate or approve other elective courses that have a substantial focus on privacy issues.
Privacy Law and Comparative Privacy Law must be taken on a graded basis. The electives may be taken on a P/NP basis.
2. Paper. A candidate must publish a paper on a privacy-related topic in a publication likely to be read by privacy professionals. Topics and publication venues require Certificate Supervisor pre-approval.
3. International Association of Privacy Professionals (IAPP) Certification. At graduation, a candidate must have one of the following IAPP certifications in good standing: CIPP/US (the recommended choice), CIPT or CIPM. Students must sit for their first administration of a certification exam no later than April 1 of their fourth semester.
4. Experiential Learning. The candidate must complete an externship or clinic, pre-approved by the Certificate Supervisor, that relates substantially to privacy issues. Alternatively, the candidate may satisfy this requirement through a pre-approved paid job (at least 150 working hours) during law school focused on privacy issues.
Requirements for LLM Students
Students pursuing an LLM in Intellectual Property or an LLM in International and Comparative Law may earn the Privacy Law Certificate by satisfying all of the requirements specified above except (a) regarding coursework, the student must get a C – or better in Privacy Law and Comparative Privacy Law but does not need to complete any electives (though we encourage students to take at least 3 electives if their schedule permits), and (b) the published paper is not required. Otherwise, LLM students are not eligible to earn a Privacy Law Certificate.
Other Details
Students planning to pursue the certificate should contact the Privacy Law Certificate Supervisor as early in their law school career as possible. Candidates must declare their intent to obtain the certificate no later than October 1 of their third semester. Late declaration requests will be considered on a case-by-case basis. All certificate requirements must be completed prior to the candidate’s graduation date. A student’s resume can reference certificate candidacy only after declaration. Students cannot earn both the Privacy Law Certificate and another certificate.
A candidate will earn the certificate with honors by averaging a B+ (3.67) or better in courses counted towards the certificate, with a minimum of 10 graded units.
