Administrative Law

Administrative law deals with government regulation – a crucial aspect of every type of law practice.  The practical focus of the administrative law course is how to work with government agencies and the regulatory law these agencies generate and enforce.  The first part of the course looks at the processes government agencies use to literally create law through rulemaking and adjudication and also engage in investigations and law enforcement.  They operate in areas as diverse as environmental law, national security, communications, foreign affairs, taxation, labor-management relations, and much more.  The second part of the course considers judicial review and how courts impose constraints on government regulation based on constitutional concepts of separation of powers and checks and balances, as well as procedural due process and other constitutionally protected rights.  The course provides grounding in the basics of administrative law which any lawyer who practices law needs to understand.  The first reading assignment in the required text will be posted on Camino.  The top five students on the wait list should attend the first day.  This course is graded with a final examination.

Advanced International Human Rights Clinic A

Enrollment in this course is limited to those students who successfully complete Course No. 727 (International Human Rights Clinic), and subject to the Clinic Director’s approval. Students enrolled in this advanced course will continue to work on previous human rights clinic projects and are expected to act as team leaders. Students must register for 2 units of academic credit, which will be graded. This is the “A” portion of the course. Additionally, students may register for up to 2 additional units that are not graded (credit/no credit). This is the “B” portion of the course. Students must submit the International Human Rights Clinic Application Form and obtain a permission number from the professor in order to register for this course (contact FJRivera@scu.edu).

Advanced Trial Techniques (Trial Team)

Enrollment based on tryouts held in spring. One year, two semester course. Students should obtain permission number from instructors. Attendance is mandatory, as well as participation in regional/national competitions. There will be a small reading assignment in preparation for the first class, to be posted online.

Biotechnology Law Seminar

Some type of biology background also recommended.  This course will introduce the issues encountered when starting up a biotech company and afterwards.  The course examines a variety of legal topics related to the biotechnology industry, such as the initial financing, the regulatory environment, intellectual property, licensing, antitrust and practical uses of biotechnology.  This class fulfills the LL.M. writing requirement.

Community Property

Bar Course. UP point eligible class. Subject to grade curve.   Students enrolled in Law 290 (Community Property – a two unit course) have the option of registering for an additional unit of credit (a one unit directed  research). The additional one unit will be satisfied by attendance at the community property lab that follows each class meeting and by submitting written exam questions and answers throughout the semester for instructor feedback. Students enrolled in Law 290 may participate in this optional lab without registering for the extra unit, if they prefer. The extra unit is offered ONLY to Law 290 students seeking an additional one unit credit in their schedule. Comparative Law Seminar

  Examination of the history, structure, and institutions of civil law, common law, and Islamic legal traditions. Although several class meetings and individual research examine substantive law, emphasis is on study of legal systems and traditions. Primary focus is private law (the equivalent of common law system’s civil obligation) and some comparative constitutional law and criminal procedure.

Comparative Privacy Law

This course surveys the approaches to privacy regulation around the globe, including a comparison of regulatory philosophies and different policy solutions. The course also introduces the major international privacy regulatory and enforcement institutions. Prerequisite:  Privacy Law (410). Students that have not taken the prerequisite that have taken and passed the CIPP exam as part of the privacy certificate are eligible. SAWR eligible.

Criminal Justice Externship : Criminal Defense

Credit/No Credit. Pre- or Co-Requisite: Evidence (320) Class will meet at the Public Defender Office. Enrollment is by application only. Applications available in the Law Student Services Office, Criminal Justice Externship Defense Clinic Form. Students will be placed at the Santa Clara County Public Defender Office where they will work on real cases with real clients under the supervision of a senior attorney. Students will conduct arraignments, pre-trial conferences, the motion calendar and, if possible, a trial. Students need to be able to commit 2 full days at the PD office. The lessons learned in this clinic will be invaluable for any students who expect to practice in the criminal justice system. Students may not participate in this clinic while working in law enforcement or in the district attorneys office due to the conflict of interest it presents. This class meets the Professional Skills requirement.

These are important topics that are tested on the California bar exam.

Course will be offered for 2 units this semester. This course will focus on legal and business issues contained in the various agreements involved in the development and distribution of video games with a primary focus on confidentiality, development, distribution, licensing and talent. Students will begin to learn the legal skills needed to analyze, negotiate, and draft agreements representing various parties in the video game industry. Although the course will focus on the video game industry, many concepts will be useful for any transactional practice.

The purpose of this course is to blend substantive patent law knowledge with practical application in a litigation context. The course emphasizes litigation skills including client relations, developing the factual record, strategic counseling, and motion practice. It will be of particular interest to those who plan to practice in the areas of patent litigation, patent prosecution, or patent licensing. The course analyzes a hypothetical patent litigation using a US Patent and file history along with other documents. Grades are based on a variety of exercises related to claim construction charts, infringement and invalidity analysis, serving and responding to discovery, expert reports, depositions, and motions as well as class participation. Juvenile Justice Topics: Practical Applications

KGACLC Workers' Rights Interviewing and Advising Clinic

Students must attend a mandatory training class on Saturday, January 14, 2017.  Thereafter, students must spend 27 hours advising at the Workers’ Rights Clinic. Clinic meets on the following Tuesdays: Jan. 17, 24 & 31; Feb. 7, 14 & 28; March 14, 21 & 28 and Thursdays: Jan. 19 & 26; Feb. 2, 9 & 16; March 2, 16. Students may not take more than one interviewing and advising class without the prior approval of the instructors. This class fulfills the Professional Skills Requirement.  Students will provide advice to low income clients regarding problems in the workplace such as wrongful termination, harassment, discrimination, unpaid wages, and failure to pay overtime. In addition to advising clients, students will also receive 13.5 hours of instruction in the Fundamentals of Employment Law class that covers wage and hour law, wrongful termination, harassment, discrimination, leave acts, workers compensation, unemployment insurance, state disability insurance, ERISA, privacy, workplace immigration issues, and union labor law.  Students may also investigate a retaliation case, domestic violence, labor trafficking, actually filed by a complainant at the State of California’s Labor Commission office and prepare an investigative report and cause or no cause finding.   This course is graded. Students may also enroll in independent study for additional units. SAWR eligible.

Labor Law: The Public Sector

Land Use

The Land Use Law course provides a unique opportunity to study how local governments operate when they regulate the use of land through planning, zoning, subdivision regulation and other controls over the use of private and public land.  Land use control strategies through nuisance law and private land use arrangements also play a role in the local land use control systems studied in this course. Primarily focusing on California law, the course will also consider constitutional issues such as takings and freedom of religion and expression that often complicate local land use controversies.  Accommodating potentially conflicting interests of landowners, neighbors, community, and regional interests, such as transportation and housing, is the main focus of the land use law course.  The first reading assignment will be posted on Camino.  The top five students on the wait list should attend the first day.  The course is graded, based on a take-home examination and class participation.  Students engaged in land use law projects may also enroll in one or more additional units of independent study eligible for SAWR certification.

Legal and Business Aspects of the Entertainment Industry

The class teaches how intellectual property is monetized across different forms of entertainment and how this monetization is the product or law and regulation.  The class focuses on the conflict of interest among content creators, content distributors and content exhibitors.  The class looks at how technology has and is changing these interests.  Student will learn the language of entertainment and be able to appreciate the competing interests among the three categories of players in the industry and the common relevant terms contained in the various relevant contract. Take home final exam. No textbook, all reading information is downloaded before the class. Mediation: Theory and Practice

Mediation and alternative dispute resolution is a growing field as clients look to lawyers to be problem solvers and to expand the pie.  This course provides students with the opportunity to develop their problem-solving and conflict-resolution skills; to examine the circumstances in which mediation is an appropriate form of dispute resolution; and to explore the role of the lawyer in mediation, either as mediator or as counsel to a client considering or participating in mediation.  Attendance and full participation in role plays and demonstrations is mandatory.    Evaluation is based on class exercises, participation, and short papers.

Mergers and Acquisitions

 This course will focus on the law affecting corporate mergers and acquisitions, with some time being devoted to spin-offs and split-ups.  JD students should have already taken Business Organizations (248) or Securities Regulation (258);  LLM students should have had a comparable basic business organization course, or relevant background and experience, or should be contemporaneously taking the basic Business Organizations (248) course.

Whether you realize it or not, you negotiate every day of your life. This course seeks to help you move from negotiating by instinct, as most people do, to negotiating more purposefully, thoughtfully, and with a stronger sense of awareness. The course merges theory with practice, in order to: (1) develop your understanding of purposeful negotiation; (2) give you tools and concepts for analyzing and preparing for negotiations; (3) enhance your negotiating skills through frequent role plays, analysis, and feedback. Given the interactive nature of this class, attendance is mandatory, and class size is limited. Any student that is interested in the class must attend the first day. Method of Evaluation: Seminar participation and short reflection papers.

Online Dispute Resolution: The State of the Art

Meet Friday, February 10th and Saturday, February 11th on the following schedule: Friday, February 10th: 5:00 p.m.-9:00 p.m. and Saturday, February 11th: 9:00 a.m.-12:00 p.m. and 1:00 p.m.-6:00 p.m. Enrollment is limited to 30 students. There are no prerequisites but knowledge of mediation would be helpful but is not required. The grade in the course will be based on class participation and a short paper. Public Interest and Social Justice Workshop: Restorative Justice Practicum

This seminar will provide an introduction to the theory and practices of restorative justice, a centuries-old approach to dispute resolution that emphasizes repairing harms by bringing together victims, offenders, their respective communities, and other stakeholders in a common quest for healing and reconciliation. Restorative justice programs exist in prisons, courts, schools, and many other settings. Students will learn the theory and practical skills of restorative justice in both real-world contexts and in-class simulations. Full engagement in the weekly sessions and a final paper are required. This is a skills course with limited enrollment.

Real Estate Conveyancing

UP point eligible course. Subject to grade curve. An overview of real estate conveyancing. The real estate industry, originating and negotiating real estate purchase contracts, escrows, recording acts, title insurance, delivery of deeds, covenants of title, real estate lending, and ground leases are among the topics to be covered in this course. The course will cover common law and California statutory modifications. It has been expanded to three units to cover more material that will be on the California Bar Exam, but this course is not a “Bar” course. Professor Collins is a practitioner in the real estate transaction area and will incorporate practical and experiential approaches.
