Students enrolled in this advanced course will continue to work on Tax Clinic cases. They may also be assigned to new cases and/or projects, or be asked to prepare and present educational tax-related presentations to the local low-income community. This advanced clinic is designed to help students further develop their professional lawyering skills, with particular emphasis on case management, time-management, interviewing, fact-finding, documenting, monitoring, and drafting documents. Students register for 2 units of academic credit, which will be graded and fulfill 50 hours per unit consisting of casework and meetings. Students must participate in mandatory weekly meetings with the Director to discuss their cases in depth. Prerequisites: Successful completion of Federal Income Tax, Course 270, Low Income Taxpayer Clinic Course, 724A and 724B, and Clinic Directors approval.

Professional Skills Course

Credit/No Credit.  Limited Enrollment.  Students represent live clients in tax appeal proceedings before the California State Board of Equalization (BOE). The clients are disadvantaged taxpayers appealing a tax liability less than $40,000, and students represent them under supervision of a faculty member who is an attorney with the Tax Appeals Assistance Program. This representation involves the direct communication with clients and with attorneys/representatives of the Franchise Tax Board and the BOE. Students will draft briefs and letters, and may have the opportunity to argue an appeal before the BOE in person. Students will work on approximately 2 to 3 cases per semester, from initial interviewing though trial and final disposition. Students meet weekly with the supervising attorney in a seminar class setting. Students receive credit for their work in practice, reflections, and case rounds with a supervisor. To receive full credit, students must attend all seminar, case rounds, and office hours and work a minimum of 100 hours (including preparation for class) per semester. This course is limited to 6 students. Federal Income Taxation is not a prerequisite or a required concurrent course, but it is recommended.

Pass/No Pass. The goal of this course is to introduce our international LL.M. students to legal analysis, writing, and research in the U.S. legal system. Instruction will cover sources of law in the United States, the common-law system, reading and briefing court decisions, articulating and synthesizing rules from legal sources, applying those rules to the facts of simulated cases, legal citation, legal research in the U.S. system, and plagiarism. We will give the students written assignments to allow them to apply the information they learn in the class. We anticipate the following assignments: (1) case briefs; (2) a written analysis in which students must analyze a hypothetical case in a “closed universe” and convey their analysis in writing, (3) research exercises, and (4) a written research assignment in which the students must conduct legal research in a hypothetical case, analyze the case under the rules they find through their research, and convey their analysis in writing. We may also have some oral presentation assignments. We will provide written feedback on the students’ work and meet with them to discuss the work.

This controversy clinic will provide upper-division students the opportunity to represent clients before the Internal Revenue Service and/or Tax Court, develop professional skills, and learn tax procedure, while directly serving the community. All students must attend an all-day skills training program on the first Saturday of the semester and a 150-minute class seminar a week, which may include one-on-one meetings with the supervising attorney. Mediation is the most common type of legal settlement, taking place in both litigation and corporate law. This class will teach the skills and techniques necessary to successfully navigate this legal negotiation process. The course merges theory with practice, in order to: (1) develop your understanding of both the processes and significance of mediation; (2) give you tools and concepts for analyzing and preparing for mediations; (3) enhance your skills through frequent role plays, analysis, and feedback.
